1. Agreement to Terms

By accessing or using the Audio AI Book service ("Service") operated by SweetWater Holding UG (haftungsbeschrankt) ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

Audio AI Book is a text-to-speech service that allows users to convert text content into audio files using artificial intelligence technology. The Service is provided on a credit-based system where users purchase credits to generate audio content.

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.

4. Purchases and Credits

4.1 Credit System

Our Service operates on a credit-based system. 1 credit equals approximately 1 minute of generated audio. Credits are purchased in advance and deducted as you generate audio content.

4.2 Payment Processing

All payments are processed securely through LemonSqueezy, our payment service provider. By making a purchase, you agree to LemonSqueezy's terms of service.

4.3 No Refunds Policy

All purchases are final and non-refundable. Due to the nature of digital services and the immediate consumption of credits for audio generation, we do not offer refunds for any purchases, including but not limited to:

• Credit purchases
• Partially used credit balances
• Unused credits
• Generated audio content that does not meet your expectations

By making a purchase, you acknowledge and agree to this no-refund policy.

4.4 Credit Validity

Purchased credits expire 1 year (12 months) from the date of purchase. Expired credits are forfeited and cannot be refunded or restored. It is your responsibility to use your credits before they expire. We may send reminder notifications, but we are not obligated to do so.

5. Acceptable Use

You agree not to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Infringe upon or violate intellectual property rights of others
• Upload, submit, or convert any copyrighted material for which you do not hold the necessary rights or licenses
• Impersonate any person or entity
• Generate content for fraudulent purposes, including voice phishing or scams
• Create deepfakes or misleading audio content intended to deceive
• Violate any applicable laws or regulations
• Attempt to gain unauthorized access to our systems or networks
• Resell or redistribute the Service without authorization

5.1 Copyrighted Material Prohibition

You are strictly prohibited from uploading, submitting, or using any copyrighted material through our Service unless you are the copyright owner or have obtained explicit written permission from the copyright holder. This includes, but is not limited to:

• Books, novels, short stories, and other literary works
• Articles, blog posts, and journalistic content
• Scripts, screenplays, and dramatic works
• Song lyrics, poems, and other creative writings
• Academic papers, research publications, and educational materials
• Any other content protected by copyright law

You represent and warrant that all content you upload or submit to the Service is either: (a) your original work, (b) in the public domain, (c) licensed under terms that permit the intended use, or (d) used with explicit permission from the copyright holder. We reserve the right to remove any content that we believe, in our sole discretion, infringes on third-party copyrights, and to terminate accounts of repeat infringers.

6. Intellectual Property

6.1 Your Content

You retain ownership of any text content you upload to the Service. You represent and warrant that you have all necessary rights, licenses, and permissions to the content you submit, and that your content does not infringe upon the copyright, trademark, or other intellectual property rights of any third party. You are solely responsible for ensuring that your use of the Service complies with all applicable copyright laws.

6.2 Generated Audio

Audio content generated through our Service is owned by you, subject to our license terms and any applicable third-party licenses. You may use generated audio for personal and commercial purposes.

6.3 Audio File Storage and Retention

Generated audio files are stored on our servers for 14 days from the date of creation. After this retention period, audio files are automatically and permanently deleted from our systems. It is your responsibility to download and save any audio content you wish to keep before the 14-day retention period expires. We are not responsible for any audio files that are deleted after the retention period, and no refunds will be issued for lost content due to expired storage.

6.4 Our Service

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of SweetWater Holding UG and its licensors.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall SweetWater Holding UG, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content
• Any content you upload, submit, or create using the Service
• Any audio content generated through the Service, including its use, distribution, or any claims arising therefrom
• Any copyright infringement or intellectual property violations resulting from your use of the Service

7.1 User Content Liability

You acknowledge and agree that you are solely responsible for all content you upload to or create through the Service. SweetWater Holding UG assumes no liability whatsoever for:

• The legality, accuracy, or appropriateness of any content you submit
• Any copyright infringement claims arising from your uploaded content
• Any use or misuse of the audio content generated from your submissions
• Any third-party claims related to content you created using the Service
• Any damages, losses, or legal fees resulting from your violation of these Terms or applicable laws

You agree to indemnify, defend, and hold harmless SweetWater Holding UG and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any copyright, trademark, or intellectual property right; or (d) any claim that your content caused damage to a third party.

7.2 No Liability for Data Loss

SweetWater Holding UG shall not be liable for any loss, corruption, or destruction of data, including but not limited to:

• Loss of uploaded text content, manuscripts, or source materials
• Loss or corruption of generated audio files
• Data loss due to system failures, server outages, or technical issues
• Data loss due to account termination or suspension
• Loss of playback progress, settings, or user preferences
• Data loss resulting from security breaches or unauthorized access
• Any data deleted after the retention period expires

You are solely responsible for maintaining backup copies of all content you upload to or create through the Service. We strongly recommend downloading and backing up your generated audio files immediately after creation. The Service is not intended to be used as a data storage or backup solution.

We do not guarantee the availability, integrity, or recoverability of any data stored on our systems. While we implement reasonable technical measures to protect data, we make no warranties regarding data security or preservation.

8. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will cease immediately.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
